1 · Who runs this site

This site is operated by Dark Defender (publicly known as @DefendDark on 𝕏, "Dark" on Patreon), operating as The Dark's Side. For all privacy-related enquiries the data controller can be contacted at Dark@defenddark.com. The operator is based in the Netherlands.

2 · What data we collect

2.1 — Data you actively provide

Contact form: if you fill out the form on the Contact page, we receive your name, email, chosen topic, and message. This is used solely to reply to you. We do not add you to any mailing list. The form is processed by Formspree (United States) — see their privacy policy at formspree.io/legal/privacy-policy.
Email correspondence: if you email us directly, your message and reply chain are stored in our mail provider until you ask us to delete them.

2.2 — Data collected automatically

Server logs: our hosting provider (HostGator) automatically logs your IP address, the date and time of your visit, the pages you requested, the referring URL, and your browser's user-agent string. These logs are retained by HostGator under their standard log-retention period for security and abuse prevention. We do not actively analyse these logs.
No site analytics: defenddark.net does not run Google Analytics, Facebook Pixel, Hotjar, or any equivalent tracking script. We do not build behavioural profiles of visitors.

3 · Cookies & similar technologies

defenddark.net does not itself set any cookies for analytics or advertising. The site uses localStorage only for technical conveniences (e.g. remembering your filter choice on the Analysis page); this stays on your device and is never sent to us.

Some third-party services we embed or call (listed below) may set their own cookies when you interact with them. We have no control over those cookies; please consult the relevant third party's policy.

Legal basis for processing: we process contact-form data on the basis of your consent (Art. 6(1)(a) GDPR) and server-log data on the basis of legitimate interest in maintaining the security and availability of the site (Art. 6(1)(f) GDPR).

International data transfers: some third-party services we use (Formspree, Patreon, Google Fonts) are based outside the EU. By using these services we rely on the providers' own GDPR safeguards, including Standard Contractual Clauses where applicable.

6.2 — No liability for losses, damages, or consequences

To the maximum extent permitted by applicable law, Dark Defender, the operator of The Dark's Side, and any contributors shall not be held liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages of any kind — including but not limited to financial loss, lost profits, lost opportunity, business interruption, data loss, or emotional distress — arising from or related to:

Your use of, or inability to use, this site or any content on it.
Any decision you make to buy, sell, hold, or otherwise transact in any cryptocurrency, token, security, commodity, index, foreign-exchange pair, derivative, or any other financial instrument.
Errors, omissions, inaccuracies, or outdated information in any analysis, chart, headline, ticker, price, or commentary published on the site.
Loss or unauthorised access to your accounts on any third-party platform (Patreon, 𝕏, MEXC, etc.) including as a result of phishing, fraud, or your own credential mismanagement.
Downtime, technical malfunctions, or data inaccuracies caused by third-party services (CoinGecko, Binance, rss2json, hosting provider, or any other provider).
Any other consequence whatsoever arising from your engagement with the content on this site.

The cap on our liability, in jurisdictions where complete exclusion is not legally enforceable, is limited to the amount you have paid us directly (which for non-members is zero).

6.3 — Third-party services are independent

Outbound links and embedded services on this site (Patreon, 𝕏, MEXC, Discord, etc.) are operated entirely by independent third parties. We do not endorse, control, or accept responsibility for their content, security practices, terms of use, or operations. Your use of any third-party service is governed solely by that service's own terms and privacy policy.

6.4 — Risk acknowledgement

Trading and holding cryptocurrencies, stocks, commodities, foreign-exchange pairs, indices, and derivative instruments carries substantial risk of partial or total loss of capital. Cryptocurrency markets in particular are highly volatile, can be subject to manipulation, can suffer sudden liquidity collapses, and may be partially or fully outlawed in your jurisdiction at short notice. You may lose more than you initially deposit when using leverage. Past performance is not indicative of future results. Only commit capital you can afford to lose entirely.

6.5 — Your responsibility

You alone are responsible for:

Verifying that cryptocurrency trading and the use of any service mentioned on this site is legal in your jurisdiction.
Reporting and paying all applicable taxes on your trading, capital gains, and other income to your local tax authority.
